TAMPA BAY PONTOON RENTALS – TERMS & CONDITIONS

By booking, renting, or operating any vessel from Tampa Bay Pontoon Rentals LLC (“Company”), the renter (“Renter”) agrees to the following Terms & Conditions:

RENTAL AGREEMENT & ELIGIBILITY Renter must be at least 21 years of age with a valid government-issued ID. Operators must comply with all Florida boating laws, including: Completion of a Boater Safety Education Course if required under Florida law. The individual signing this agreement assumes full responsibility for the vessel and all passengers.

BAREBOAT CHARTER DISCLOSURE This is a bareboat rental unless otherwise explicitly stated. Renter has the option to: Operate the vessel themselves (if qualified), OR Select a Captain from a provided list, OR Provide their own qualified Captain. Captains are independent contractors, not employees of Tampa Bay Pontoon Rentals. Captain fees are: Separate from the rental cost Paid directly between Renter and Captain The Company does not assign or require a specific Captain.

INSURANCE & LIABILITY Insurance may be offered through a third-party provider (e.g., vQuip) upon booking acceptance. Renter understands: Insurance coverage is optional unless otherwise stated Renter assumes full financial responsibility for damages if coverage is declined The Company’s insurance does NOT cover renters or passengers.

ASSUMPTION OF RISK Boating involves inherent risks including, but not limited to: Drowning, collisions, weather conditions, marine life encounters Renter agrees to assume all risks for themselves and their passengers Renter is responsible for: Ensuring all passengers follow safety guidelines Use of life jackets where required

SECURITY DEPOSIT & DAMAGES A security deposit may be required prior to departure Renter is responsible for: Any damage to vessel, equipment, or third-party property Lost or stolen items Charges may include: Repairs Cleaning fees (excessive mess, stains, etc.) Downtime/loss of business

FUEL POLICY Fuel is NOT included unless explicitly stated Fuel usage will be: Charged at market rate OR Deducted from security deposit Vessel must be returned with the agreed fuel level

PROHIBITED USES The following are strictly prohibited: Operating under the influence of alcohol or drugs Reckless or negligent operation Exceeding maximum passenger limits (per USCG regulations) Use in offshore or Gulf waters (unless explicitly authorized) Towing activities unless approved Commercial use, subleasing, or unauthorized charters

NAVIGATION RESTRICTIONS Vessel is restricted to approved waterways only Certain areas (e.g., open Gulf, restricted zones) are off-limits GPS/navigation aids may be provided, but: Renter is solely responsible for safe navigation

WEATHER POLICY Rentals may be: Delayed, rescheduled, or canceled due to unsafe weather Determination of unsafe conditions is at the sole discretion of the Company No refunds for: Light rain Overcast conditions

CANCELLATIONS & REFUNDS Cancellation terms may vary depending on booking platform Generally: Full refund if canceled within designated timeframe No-shows or late cancellations may forfeit payment Weather-related cancellations: Rescheduled or credited at Company discretion

LATE RETURNS Late returns will incur additional charges: Hourly rate or prorated fee Continued late return may result in: Additional penalties Forfeiture of deposit

CLEANLINESS & CONDITION Vessel must be returned in reasonable condition Excessive cleaning will result in fees, including: Trash removal Sand, spills, or damage to upholstery

INDEMNIFICATION Renter agrees to indemnify and hold harmless Tampa Bay Pontoon Rentals LLC from: Claims, damages, injuries, or losses arising from: Use of the vessel Actions of Renter or passengers

MECHANICAL FAILURE In the event of mechanical issues: Company will attempt to resolve or provide replacement where possible Refunds (if any) will be prorated based on lost time

VIOLATION OF TERMS Violation of any terms may result in: Immediate termination of rental Forfeiture of all payments and deposits Possible reporting to law enforcement

GOVERNING LAW This agreement is governed by the laws of the State of Florida Any disputes shall be handled in Pinellas County, Florida

ACKNOWLEDGMENT By completing this booking, Renter acknowledges: They have read and understood these Terms & Conditions They agree to be legally bound by them They accept full responsibility for the vessel and all passengers

FWC LIVERY DISCLOSURE This rental operates under applicable Florida Fish and Wildlife Conservation Commission (FWC) livery regulations Renter acknowledges responsibility for: Vessel operation Passenger safety Compliance with all applicable laws
